Terms of Use (EULA)
Please read these Terms of Use ("Terms", "Agreement") carefully before using the Melody Music mobile application ("the App", "Service") operated by us.
By downloading, accessing, or using Melody Music, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the application.
1. Use of the Service
Melody Music provides artificial intelligence tools enabling users to generate original music tracks, melodies, and synthesized voice audio from user-provided text prompts.
- You must be at least 13 years of age (or the minimum legal age in your territory) to use this Service.
- You are granted a non-exclusive, non-transferable, revocable license to use the application for your personal and commercial creative projects in accordance with these Terms.
2. Acceptable Use Policy
You agree not to misuse the Service. Specifically, you may not submit prompts or use the app to generate, promote, or distribute:
- Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful.
- Audio impersonations intended to deceive, defraud, defame, or harass individuals without authorization (deepfakes or malicious impersonation).
- Content that infringes any patent, trademark, copyright, or proprietary rights of any party.
- Attempts to reverse engineer, decompile, or disrupt our backend infrastructure or APIs.
3. Intellectual Property & AI Generated Content
As between you and Melody Music, you retain the rights to utilize, download, and share the audio content generated through your use of the App, subject to applicable local laws regarding AI-generated output. You acknowledge that AI generation relies on algorithmic models and outputs may have similarities across users with identical or similar prompts.
4. Third-Party Services & Apple Standard Terms
This application is distributed through Apple's App Store. You acknowledge that these Terms are concluded between you and Melody Music only, and not with Apple Inc. Apple is not responsible for the application or its content. Use of the App is also governed by Apple’s standard Licensed Application End User License Agreement (EULA).
5. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Melody Music, its creators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your access to or use of the application.
7. Modifications to the Service and Terms
We reserve the right to modify or discontinue the Service, or update these Terms at any time. Your continued use of the app after any changes indicates your acceptance of the updated Terms.
